2.1 Core Features

• Farm Management: Tools for managing farms, flocks, livestock inventory, and agricultural operations
• Health Records: Digital health tracking, vaccination schedules, treatment records, and mortality tracking
• Production Tracking: Recording and analysis of production data including eggs, weight, feed consumption, and yield
• Financial Management: Expense tracking, income recording, financial reports, and profitability analysis
• Veterinary Services: Platform connecting farmers with licensed veterinarians for consultations, diagnoses, and treatment plans
• Marketplace: Digital marketplace for buying and selling agricultural products, livestock, and farm supplies
• AI-Powered Analysis: Artificial intelligence tools for disease detection, feed optimization, and farm performance analysis
• Communication Tools: Messaging, notifications, and collaboration features for farmers, workers, and veterinarians
• Offline Functionality: Ability to record data offline with automatic synchronization when connectivity is restored

2.2 Service Availability

The Service is provided "as is" and "as available" without warranties of any kind, either express or implied. We reserve the right to modify, suspend, or discontinue any part of the Service at any time, with or without notice. We do not guarantee that the Service will be available at all times or that it will be error-free.

3.1 Account Creation Requirements

• •You must be at least 18 years old to create an account and use the Service
• •You must provide accurate, current, and complete information during registration
• •You must maintain and promptly update your account information to keep it accurate
• •One person or entity may maintain only one account per user type (farmer, veterinarian, farm worker)
• •You must have the legal capacity and authority to enter into these Terms

3.2 Account Security

• •You are solely responsible for maintaining the confidentiality of your account credentials (username, password, PIN)
• •You are responsible for all activities that occur under your account, whether authorized or not
• •You must immediately notify us of any unauthorized use of your account or any breach of security
• •We are not liable for any loss or damage arising from unauthorized account access due to your failure to maintain account security
• •You must use a strong, unique password and enable two-factor authentication when available

3.3 Account Verification

Certain features of the Service may require account verification. For veterinarians, this includes verification of professional licenses, qualifications, and credentials. We reserve the right to suspend or terminate accounts that fail verification or provide false information.

4.1 Not a Substitute for Professional Advice

• Information provided through the Service, including AI-generated analysis, is for informational and educational purposes only
• AI-powered disease detection and recommendations are tools to assist decision-making, not definitive diagnoses
• Always consult with licensed veterinarians for animal health decisions, diagnoses, and treatment plans
• Emergency situations require immediate professional veterinary care - do not rely solely on the Service
• Feed optimization and nutritional recommendations should be reviewed by qualified animal nutritionists

4.2 No Veterinary-Client Relationship

Use of the Service, including communication with veterinarians through the platform, does not automatically create a veterinarian-client relationship. Such relationships are established through separate agreements and professional standards. The Service is a platform that facilitates connections but does not guarantee the quality, accuracy, or appropriateness of advice provided by third-party veterinarians.

4.3 User Responsibility

You acknowledge and agree that you are solely responsible for:

• •Seeking appropriate professional veterinary care for your animals
• •Verifying the credentials and qualifications of veterinarians before engaging their services
• •Making informed decisions based on professional advice, not solely on Service recommendations
• •Ensuring compliance with local agricultural and veterinary regulations

5.1 Prohibited Activities

• Violate any applicable laws, regulations, or third-party rights
• Upload, post, or transmit any content that is illegal, harmful, threatening, abusive, harassing, defamatory, or invasive of privacy
• Impersonate any person or entity or falsely claim affiliation with any person or entity
• Interfere with or disrupt the Service, servers, or networks connected to the Service
• Attempt to gain unauthorized access to any portion of the Service or other accounts
• Use automated systems (bots, scrapers) to access the Service without permission
• Reverse engineer, decompile, or disassemble any part of the Service
• Use the Service for any commercial purpose not authorized by us
• Collect or harvest information about other users without their consent
• Upload viruses, malware, or other malicious code
• Engage in fraudulent, deceptive, or misleading practices

5.2 Marketplace Conduct

When using the marketplace features, you agree to:

• •Provide accurate product descriptions, prices, and availability information
• •Fulfill orders and transactions in good faith
• •Resolve disputes fairly and promptly
• •Comply with all applicable consumer protection and commercial laws

6.1 Our Intellectual Property

The Service, including its original content, features, functionality, design, logos, trademarks, and software, is owned by Lamwa Vetcare and is protected by international copyright, trademark, patent, trade secret, and other intellectual property laws. You may not copy, modify, distribute, sell, or lease any part of the Service without our prior written consent.

6.2 Your Content

You retain ownership of any content you upload, post, or submit to the Service ("User Content"). By submitting User Content, you grant us a worldwide, non-exclusive, royalty-free, perpetual, irrevocable, and sublicensable license to use, reproduce, modify, adapt, publish, translate, distribute, and display such User Content in connection with operating and providing the Service.

You represent and warrant that you own or have the necessary rights to grant this license and that your User Content does not violate any third-party rights.

7.1 Subscription Plans

The Service may offer various subscription plans with different features and pricing. Subscription fees are billed in advance on a monthly or annual basis. By subscribing, you agree to pay all fees associated with your selected plan.

7.2 Payment Processing

Payments may be processed through third-party payment processors, including M-Pesa and other payment gateways. You agree to provide accurate payment information and authorize us to charge your payment method for all fees.

7.3 Refunds and Cancellations

Subscription fees are generally non-refundable. You may cancel your subscription at any time, and cancellation will take effect at the end of the current billing period. We reserve the right to modify pricing with 30 days' notice.

8.1 Disclaimer of Warranties

We do not warrant that:

• •The Service will be uninterrupted, timely, secure, or error-free
• •Any errors or defects will be corrected
• •The Service is free from viruses or other harmful components

8.2 Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, IN NO EVENT SHALL LAMWA VETCARE, ITS AFFILIATES, DIRECTORS, OFFICERS, EMPLOYEES, AGENTS, OR LICENSORS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO:

• •Loss of profits, revenue, data, or use
• •Business interruption
• •Personal injury or property damage
• •Loss of livestock or agricultural products
• •Damages arising from reliance on Service recommendations or AI analysis

OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID TO US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM, OR ONE HUNDRED DOLLARS ($100), WHICHEVER IS GREATER.

10.1 Termination by You

You may terminate your account at any time by contacting us or using the account deletion feature in your settings. Upon termination, your right to use the Service will immediately cease.

10.2 Termination by Us

We may suspend or terminate your account immediately, without prior notice, if you:

• •Violate these Terms or our Privacy Policy
• •Engage in fraudulent, illegal, or harmful activities
• •Fail to pay subscription fees when due
• •Provide false or misleading information

10.3 Effect of Termination

Upon termination, your access to the Service will be revoked, and we may delete your account and associated data in accordance with our Privacy Policy and data retention policies. Provisions of these Terms that by their nature should survive termination will survive.

11.1 Governing Law

These Terms shall be governed by and construed in accordance with the laws of Kenya, without regard to its conflict of law provisions.

11.2 Dispute Resolution

Any disputes arising out of or relating to these Terms or the Service shall be resolved through good faith negotiation. If negotiation fails, disputes shall be submitted to binding arbitration in accordance with Kenyan arbitration laws, or resolved in the courts of Kenya.
